Mabo discovered that the belief that Torres Straight Islands would always belong to his people was untrue since it came under the possession of the Crown due to terra nullius. This doctrine grants sovereignty to a state in cases where there is an absence of a ruling institution.

Eddie Koiki Mabo took on the Australian government for the recognition of ownership of Murray Island, where his ancestors have lived for generations. In 1992, six months after Mabo's death, the highest court ruled in Mabo's favor.
